This Refund Policy applies to all subscription purchases made through www.passionforproperty25.com (“Website”).

Passion for Property 25 Pty Ltd (“we”, “our”, “us”) operates an online marketplace that enables property owners and their representatives to advertise off-market properties at no cost and allows prospective buyers (“Subscribers”) to purchase subscription access to view and enquire on listed properties.

By purchasing a subscription, you acknowledge and agree to this Refund Policy.

  1. Subscription Products

Subscribers may purchase access passes including:

  • 7-Day Subscription Pass
  • 30-Day Subscription Pass

A subscription grants the Subscriber access to view off-market property listings and related information available on the Website during the subscription period.

Subscription fees are payable in advance and provide immediate access to digital content and services.

  1. No Refunds After Access is Granted

To the maximum extent permitted by law, subscription fees are non-refundable once access to the Website has been provided.

As Subscribers receive immediate access to digital content, property listings, contact opportunities, and other member-only features upon activation, no refund, credit, exchange, or partial refund will be provided for:

  • Change of mind;
  • Purchasing the wrong subscription package;
  • Failure to use the subscription;
  • Failure to locate a suitable property;
  • Failure to contact sellers;
  • Failure to receive responses from sellers;
  • Dissatisfaction with the quantity or quality of available listings;
  • Dissatisfaction with property prices or market conditions;
  • Purchasing an alternative property elsewhere;
  • Early cancellation of the subscription;
  • Inability to complete a property transaction;
  • User misunderstanding of the Website’s purpose or services.

The subscription fee is for access to the platform and listings, not for a guaranteed property purchase outcome.

  1. No Guarantee of Property Availability or Purchase

Passion for Property 25 Pty Ltd does not guarantee:

  • A minimum number of listings;
  • Continuous availability of any specific property;
  • That listed properties will remain available;
  • That a property will meet a Subscriber’s requirements;
  • That a Subscriber will successfully purchase a property;
  • That a seller will respond to enquiries;
  • Any investment outcome, capital growth, rental return, or financial benefit.

Listings may be added, updated, withdrawn, sold, leased, removed, or modified at any time without notice.

Accordingly, no refund will be available due to changes in listing inventory or market conditions.

  1. Subscription Period

Subscriptions expire automatically at the end of the purchased access period.

Unused subscription periods:

  • Cannot be paused;
  • Cannot be transferred;
  • Cannot be redeemed for cash;
  • Cannot be rolled over;
  • Are not eligible for refunds or credits.

Subscribers are responsible for using the service during the active subscription period.

  1. Seller Listings

Property owners and sellers may list properties free of charge.

As no fee is charged to sellers for standard listings, there is generally no entitlement to any refund relating to seller listings.

  1. Technical Service Issues

If a material technical fault solely caused by Passion for Property 25 Pty Ltd prevents a Subscriber from accessing subscription content for a significant portion of their subscription period, we may, at our sole discretion:

  • Extend the subscription period;
  • Restore access;
  • Provide account credit;
  • Offer a partial refund; or
  • Offer a full refund.

Any remedy will be determined after investigation of the relevant circumstances.

  1. No Refunds for Third-Party or User Issues

Refunds will not be provided for issues arising from:

  • Internet connectivity problems;
  • User devices or browser settings;
  • Incorrect account information;
  • Forgotten passwords;
  • Payment processing delays caused by financial institutions;
  • Email delivery issues;
  • User error or misuse of the Website;
  • Temporary maintenance or upgrades;
  • Force majeure events;
  • Circumstances beyond our reasonable control.
  1. Duplicate Payments

If a Subscriber is charged multiple times for the same subscription due to a payment system error, Passion for Property 25 Pty Ltd may, after verification, refund the duplicate payment amount.

Requests regarding duplicate transactions must be submitted within 14 days of the transaction date.

  1. Australian Consumer Law

Nothing in this Refund Policy excludes, restricts, or modifies any rights or remedies available under the Australian Consumer Law (“ACL”).

If our services suffer a major failure under the ACL, you may be entitled to a remedy including a refund, replacement, repair, or compensation, as determined by applicable law.

Any rights under the ACL are separate from and in addition to the terms of this Refund Policy.

  1. Fraudulent Activity and Account Suspension

We reserve the right to suspend, restrict, or terminate access to any account where we reasonably suspect:

  • Fraudulent activity;
  • Chargeback abuse;
  • Unauthorised account sharing;
  • Misrepresentation;
  • Breach of our Terms and Conditions;
  • Illegal or improper use of the Website.

Where an account is suspended or terminated due to a breach by the user, no refund will be payable.

  1. Chargebacks

Before commencing any chargeback request, Subscribers agree to contact us and provide reasonable opportunity to investigate and resolve the matter.

Where a chargeback is found to be fraudulent, misleading, or without reasonable basis, we reserve the right to recover:

  • The subscription amount;
  • Chargeback fees;
  • Administrative costs;
  • Collection costs; and
  • Legal costs where permitted by law.
  1. Limitation of Liability

To the maximum extent permitted by law:

  • Passion for Property 25 Pty Ltd provides an online marketplace only.
  • We do not act as a real estate agent, buyer’s agent, conveyancer, mortgage broker, or legal adviser unless expressly stated otherwise.
  • We do not guarantee the accuracy, completeness, legality, suitability, or availability of any listing.
  • Subscribers must undertake their own due diligence before entering into any transaction.
  • Our total liability arising from any subscription purchase will not exceed the amount paid by the Subscriber for that subscription.
  1. Refund Requests

Any refund request must be submitted in writing to:

  • Subscriber name;
  • Email address;
  • Transaction date;
  • Subscription type;
  • Payment reference number;

We may amend this Refund Policy at any time by publishing an updated version on the Website.

The version in force at the time of purchase will apply to the relevant subscription transaction unless otherwise required by law.
